AUCTA COPYRIGHT AND DMCA POLICY
Version 1.0 · In force from 12 October 2026 · Final
CaptaFlow LLC, the provider of the Aucta platform, respects the intellectual property of others and expects users to do the same. This policy explains how to report copyright infringement on Aucta, how to respond if your content is removed, and what happens to repeat infringers. It is part of the Aucta Terms of Service.
Designated copyright agent
Notices under the Digital Millennium Copyright Act (17 U.S.C. § 512) should be sent to our registered agent:
Copyright Agent, CaptaFlow LLC
6004 Lakehurst Dr, Baltimore, MD 21210
support@getaucta.com
U.S. Copyright Office designation DMCA-1082744
Email is the fastest route. Please put "DMCA notice" in the subject line.
Reporting infringement (takedown notice)
If you believe content on Aucta infringes a copyright you own or control, send a written notice that includes:
- Identification of the copyrighted work you claim is infringed (or a representative list if there are several).
- Identification of the material you claim is infringing and enough information for us to locate it, such as the account, listing or page URL.
- Your name, mailing address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
A notice that does not include these elements may not be effective. Misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. § 512(f).
What we do with a notice
On receiving a valid notice we will remove or disable access to the material promptly, notify the user who posted it, and give them a copy of the notice. We may also record the notice and share it with the user or with a third-party clearinghouse.
Counter-notice
If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the agent above that includes:
- Identification of the material that was removed and where it appeared before removal.
- Your name, address, telephone number and email address.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the United States, any district in which CaptaFlow LLC may be found), and that you will accept service of process from the person who sent the original notice or their agent.
- Your physical or electronic signature.
On receiving a valid counter-notice we will forward it to the original complainant. If they do not notify us within ten (10) business days that they have filed a court action seeking to restrain the activity, we may restore the material in ten to fourteen (10–14) business days after receiving the counter-notice.
Repeat infringers
We close the accounts of users who are the subject of repeated valid infringement notices, and we may close an account after a single notice where the infringement is clear or deliberate.
Trademarks and other rights
This policy covers copyright. For claims involving trademarks, counterfeit goods, rights of publicity or other rights, email support@getaucta.com with "Rights complaint" in the subject line and the same identifying information, and we will review it under the Terms of Service.
